Have you heard of the Form N244?
Last November we had an inquiry come through our website from a guy who had been issued with a notice of possession hearing to attend court and he was seeking help on finding a way of having this suspended to give him time to get his affairs in order and a plan in place that would eventually get him back on track with his mortgage arrears.
I asked him if he had heard of a Form N244 to which he replied that he had not, so I explained to him that he might want to consider applying for one as it has been seen as a valuable tool for ensuring a fair and just legal process in the UK.
One of its primary uses is to request variations to existing court orders, but it can also be used to request adjournments and allows applicants to provide reasons for the adjournment request and seek the court’s approval for a new hearing date.
This, I explained, would help get him the hearing suspension he seeked whilst allowing him time to get his plan and affairs together. However, I did also say that he would need to take extra care in putting forward the reasons for requesting the action and also be fully prepared as there are a series of questions followed by a statement of truth. The application needs to be downloaded and printed before being completed, then submitted in person to the court where the hearing is due to take place.

There is a cost for the application, which varies on which action you are requesting, but last time I looked on the .GOV website, costs were between £14 and £255.
